Description of the process

Ground-mounted and rooftop PV: installations with installed capacity less than or equal to 50 MW are authorised without the need to submit an application for the administrative licence regime (art. D. 311-3 and R. 311-4, Code de l’Energie), which is the case for all other electricity production installations (Art. L. 311-1, Code de l’Energie).
According to Art. R311-5, Code de l’Energie, in case the installed capacity is greater than 50 MW, an application must be filed to the DGEC.
The Ministry of Energy shall ensure for the authorizations to be published in the Official Journal. This publication must include information on the installation's production capacity, source energies, production processes, and location (Code de l'Energie, art. R311-11-1). The authorization can also be revoked if the installation has not been commissioned within 3 years of the date of issuance, or if it has not been operated for 3 years in a row after the date of issue. If this is due to force majeure, the Ministry of Energy may extend the 3-year deadline for up to ten years from the start of the extra three years.
