Hydrogen Policies
Portugal is actively developing its hydrogen sector, mainly green hydrogen, as part of its decarbonisation and energy independence goals. The National Hydrogen Strategy (EN-H2), launched in 2020, provides a roadmap for hydrogen production, storage, and integration with the national and EU energy markets. This strategy prioritises green hydrogen production, aiming to leverage renewable resources like wind and solar to make Portugal a key player in hydrogen export to Europe.
Regulatory Framework and Legislation
Decree-Law 162/2019 of 25 October and Decree-Law 15/2022 of 14 January lay the foundation for integrating hydrogen by setting regulations on renewable energy generation, grid access, and market involvement. DL 15/2022, in particular, enables flexible market participation, which benefits hydrogen producers looking to join the renewable energy market.
Decree-Law 62/2021 of 19 August transposes the EU Renewable Energy Directive (RED II) into Portuguese law, establishing the regulatory groundwork for renewable gases, including hydrogen. It also introduces a certification system for renewable hydrogen, with guarantees of origin (GOs) to verify the renewable status of hydrogen, thus meeting EU sustainability standards and enhancing market trust.
Additionally, Ordinances 168/2024 of 18 June and 98-A/2022 of 18 February are essential regulations that provide further guidance and specific frameworks within Portugal's hydrogen strategy. These ordinances aim to streamline administrative processes, clarify technical requirements, and enhance market integration for hydrogen production and consumption market integration.
These ordinances collectively strengthen Portugal's hydrogen strategy, supporting its energy transition goals, economic growth, and positioning as a renewable hydrogen exporter.
